Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Ethan Khoce, an independent developer based in Singapore ("CutPuff", "we", "us", or "our"), governing your use of the CutPuff: Quit Vaping mobile application (the "App") and the website at cutpuff.com (the "Site"). The App and the Site together are the "Service".
Please read these Terms carefully. By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. The Service is not intended for and may not be used by anyone under 18.
2. Health disclaimer (please read carefully)
CutPuff is a self-help and wellness tool designed to help you track and gradually reduce your vaping. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.
- The content and features in the Service are for general informational and self-tracking purposes only.
- CutPuff is not a substitute for professional medical advice. Always seek the advice of a qualified healthcare provider with any questions about quitting nicotine, withdrawal symptoms, or your health.
- Nicotine is addictive, and stopping or reducing nicotine can cause withdrawal effects. If you are pregnant, have a medical condition, or take medication, speak with a healthcare professional before changing your nicotine use.
- We make no guarantee about any particular outcome, including that you will reduce or quit vaping.
- Never disregard or delay seeking professional medical advice because of something you have seen in the Service.
- If you think you may have a medical emergency, contact your local emergency services immediately. You can also reach a quitline for support, such as 1-800-QUIT-NOW in the United States, or the equivalent service in your country.
Your use of the Service is at your own discretion and risk.
3. Your account
To use the App you create an account and sign in using a passwordless one-time code sent to your email, or by using Sign in with Apple. You are responsible for keeping access to your email and device secure, and for all activity that occurs under your account. Please notify us through https://cutpuff.com/contact if you believe your account has been accessed without your permission. You agree to provide accurate information and to keep it up to date.
4. Licence to use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on an Apple-branded device that you own or control, and to use the Service for your own personal, non-commercial purposes. This licence is also governed by the Apple App Store Terms of Service. We reserve all rights not expressly granted to you.
5. Subscriptions, free trial, and billing
CutPuff is offered on a subscription basis, and full access to the App requires an active free trial or paid subscription.
Plans. We currently offer a Quarterly plan at US$19.99 per 3 months and a Yearly plan at US$54.99 per year. Prices may vary by country and currency, and the exact price and plan details are shown to you in the App before you purchase.
Free trial. New subscribers may be offered a 3-day free trial. If you do not cancel at least 24 hours before the trial ends, your subscription will begin automatically and your payment method will be charged for the plan you selected.
Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged the applicable price at confirmation of purchase and at each renewal.
Managing and cancelling. Your subscription is billed and managed through your Apple App Store account. You can view, manage, or cancel your subscription at any time in your device Settings under your Apple ID subscriptions. Deleting the App does not cancel your subscription.
Refunds. Purchases are processed by Apple, and refunds are handled by Apple in accordance with the App Store terms and applicable law. We generally cannot grant refunds directly. Except where required by law, payments are non-refundable and there are no refunds or credits for partially used periods.
Price changes. We may change subscription prices. Where required, Apple will notify you of a price increase and, depending on the change, ask you to confirm before it takes effect.
6. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms
- copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract the source code, except where the law permits
- interfere with or disrupt the Service or the servers and networks that support it
- attempt to gain unauthorised access to any part of the Service, other accounts, or our systems
- use any automated means to access the Service or collect data from it without our permission
- upload or transmit malware or any harmful code.
7. Intellectual property
The Service, including its software, design, text, graphics, logos, and the CutPuff name and branding, is owned by CutPuff or its licensors and is protected by intellectual property laws. Except for the limited licence granted to you in these Terms, nothing gives you any right, title, or interest in the Service or our intellectual property.
8. Your content
The Service lets you enter information such as goals, logs, and notes ("Your Content"). You retain ownership of Your Content. You grant us a limited licence to host, store, and process Your Content solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for Your Content and confirm you have the right to provide it.
9. Third-party services
The Service relies on third-party services, including the Apple App Store, Google Firebase, and RevenueCat. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not control them.
10. Apple App Store terms
Because the App is made available through the Apple App Store, the following terms apply, and you acknowledge and agree that:
- These Terms are between you and CutPuff only, and not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App. CutPuff is solely responsible for maintenance and support, to the extent it is required under these Terms.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price you paid for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and CutPuff is solely responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty.
- CutPuff, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar laws.
- In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, CutPuff, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
- You represent and warrant that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any results obtained from using it will be accurate or reliable. This section does not limit the health disclaimer in Section 2.
12. Limitation of liability
To the maximum extent permitted by law, CutPuff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or US$50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be limited or excluded by law.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless CutPuff from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your misuse of the Service or your breach of these Terms.
14. Termination
You may stop using the Service at any time and delete your account from within the App. We may suspend or terminate your access to the Service if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will survive.
15. Changes to the Service and these Terms
We may modify or discontinue all or part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide notice within the App or on the Site where appropriate. Your continued use of the Service after changes take effect means you accept the revised Terms.
16. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to its conflict of law rules. You and CutPuff agree to submit to the exclusive jurisdiction of the courts of Singapore to resolve any dispute arising out of or relating to these Terms or the Service. If you are a consumer, you may also benefit from any mandatory protections and rights available to you under the laws of your country of residence, and nothing in this section removes those rights. Before starting any formal dispute, we encourage you to contact us through https://cutpuff.com/contact so we can try to resolve the matter.
17. General
These Terms, together with the Privacy Policy, are the entire agreement between you and CutPuff regarding the Service. If any provision is found to be unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
